These Terms govern your use of this website and the services provided by Peak Performance Consulting. By using this website, contacting us, or engaging us for services, you agree to these Terms.

We’ve written them clearly because we believe transparency builds trust — the same principle that guides our coaching work.

About Us

Peak Performance Consulting is owned and operated by Peter Neufeldt in Regina, Saskatchewan, Canada. Despite “Consulting” in the business name, our work is best described as coaching, leadership development, and assessment facilitation — not consulting. This distinction matters for how we engage with clients (see “Nature of Our Services” below).

The Services We Provide

Peak Performance Consulting offers:

  • Executive and leadership coaching — one-on-one and program-based
  • Leadership workshops and training — delivered in person and virtually
  • Licensed programs from Brian Tracy Solutions: High Performance Leadership, Perform At Your Best, and Time Management for Results
  • Personal and team assessments administered under license from Target Training International (TTI) — including Talent Insights, TriMetrix®, and EQ assessments

Services are delivered by Peter Neufeldt and, where applicable, associates working under his direction.

Nature of Our Services — Important Disclaimers

Coaching is not therapy or professional advice

Coaching is a thought-partnership. The coach does not provide professional advice, diagnoses, or treatment. Our services are not a substitute for:

  • Medical or psychological care. We are not therapists, counselors, psychologists, or mental-health professionals.
  • Legal advice. We do not practice law. Consult a lawyer for legal questions.
  • Financial, tax, or investment advice. We do not provide financial advice. Consult a qualified financial advisor or accountant.

If you are experiencing a mental-health emergency, please contact a licensed mental-health professional or dial 911 (or your local emergency number).

Results are not guaranteed

Results from coaching, workshops, and assessments depend on many factors — including individual commitment, organizational context, timing, and market conditions. We do not guarantee specific outcomes, business results, or income. Where we offer a satisfaction guarantee on a specific program, the terms of that guarantee control what we commit to (see “Refunds and Satisfaction Guarantee” below).

Your responsibility for decisions and actions

You are fully responsible for all decisions made and all actions you take whether they arise from participation in a Peak Performance coaching program or not. Your Peak Performance coach is there to help you clarify your goals, focus on personal and professional development, and provide structure, process, and accountability to help you achieve your goals. Where prudent, you agree to seek legal, financial, and other advice from professionals specializing in the specific fields of your concern prior to making any significant changes.

Coaching confidentiality is not a legal privilege

We treat your coaching conversations as confidential. However, coaching confidentiality is not the same as attorney-client or doctor-patient privilege. A coach can be compelled by a court order to testify or produce records.

Third-Party Licensing and Affiliations

Peak Performance Consulting holds current licensing agreements with:

  • Brian Tracy Solutions — to deliver specific Brian Tracy leadership and development programs, including High Performance Leadership, Perform At Your Best, and Time Management for Results
  • Seven Stages of Growth — to deliver the Seven Stages of Growth framework for business development
  • Target Training International, Ltd. (TTI Success Insights) — to administer personality, behavioral, EQ, and leadership assessments including Talent Insights, TriMetrix®, and EQ assessments

Peter Neufeldt is an independent business owner and is not an employee, agent, or official representative of Brian Tracy Solutions, Seven Stages of Growth, TTI, or any other organization referenced on this website.

Peter has also completed certifications through earlier Brian Tracy–related programs. These certifications were earned under previous programs, are separate from the current Brian Tracy Solutions licensing arrangement, and may be documented on request.

Each licensor’s own terms and privacy practices apply to the materials, assessments, and results delivered under their respective license.

Client Engagements

For each coaching engagement, workshop, or assessment, a separate written agreement describes the scope, duration, schedule, deliverables, and fees. These Terms apply to your general use of our website and services; where a specific engagement agreement and these Terms conflict, the engagement agreement controls for that engagement.

Invoicing and Payment

We invoice for services through Square, typically after services are delivered (unless your engagement agreement specifies otherwise).

  • Prices are in Canadian dollars (CAD)
  • Goods and Services Tax (GST) applies; Saskatchewan Provincial Sales Tax (PST) may apply to certain service categories
  • Payment terms are Net 30
  • Late payments accrue a service charge of 1.5% per month (approximately 19.56% APR)
  • If an account is referred to collections, you agree to pay reasonable collection costs and legal fees

Payments are processed by Square, a PCI-DSS-compliant payment processor. We do not store your credit card information.

If we offer pay-per-program online purchases in the future, those transactions will be governed by these Terms plus any additional terms displayed at checkout.

Refunds and Satisfaction Guarantee

Services that have been delivered are generally non-refundable, except as stated below or in your specific engagement agreement.

Coaching satisfaction guarantee

For any reason after the first two coaching sessions, if you’re not fully satisfied and you wish to discontinue the coaching agreement, we will unconditionally refund 100% of your investment.

To claim the guarantee, contact us through the contact form and let us know you wish to discontinue. Program-specific guarantee language, where provided at enrollment, applies in addition to these Terms; where a conflict exists, the program-specific terms control.

Cancellation, Rescheduling, and No-Shows

Workshops

  • Cancellations made 14 or more days before a scheduled workshop receive a full refund
  • Cancellations made 7–13 days before receive a 50% refund or full credit toward a future session
  • Cancellations made fewer than 7 days before may be rescheduled but are not eligible for refund

Coaching sessions

Coaching sessions may be rescheduled with 48 hours’ advance notice without fee. Sessions missed or cancelled within that window are forfeited.

We understand that plans change. If circumstances are exceptional, reach out and we will work with you.

Intellectual Property

Our materials

Original content on this website and in our coaching and workshop materials — including text, frameworks, handouts, slide decks, and assessment interpretations — is the property of Peak Performance Consulting. When you engage us for services, you receive a limited, non-transferable, non-sublicensable license to use the materials we provide for your personal or internal organizational learning. You may not reproduce, distribute, or create derivative works for external use without our written permission.

Licensed materials

Materials provided through our Brian Tracy Solutions license (High Performance Leadership, Perform At Your Best, Time Management for Results) remain the intellectual property of Brian Tracy Solutions. Assessment materials and reports remain the property of TTI Success Insights.

Your materials

Anything you write, record, or create during a coaching engagement — journal entries, goal sheets, reflections, emails you send us — remains yours. We reference them only in the context of our coaching work with you, and we will not share them without your consent.

Session recordings

Coaching sessions are not recorded by default. If a session is recorded, it is only with the written consent of both parties. Recordings are for the personal use of the party who requested them and may not be published or shared without mutual written consent.

Testimonials and case studies

We may share anonymized reflections on coaching engagements to illustrate what we do. Named testimonials, case studies, or other client identification require your written consent.

Confidentiality

We treat coaching conversations and engagement information as confidential. We will not disclose what you share with us except in the following cases:

  • You give us written consent to share
  • We are required by a valid court order, subpoena, or other legal obligation
  • We reasonably believe there is an imminent risk of harm to you or to another person
  • You disclose ongoing or planned illegal activity
  • In corporate-sponsored engagements, we may share with the sponsor only what has been agreed in advance — typically attendance, high-level themes, and agreed-upon goals, never verbatim session content
  • We may discuss our work in anonymized form with professional supervisors, mentor-coaches, or peer consultation groups that are themselves bound by confidentiality

As noted above, coaching confidentiality is not a legal privilege.

Electronic Communications

You consent to communicating with us by email, phone, video conference (Zoom, Teams, Google Meet), SMS, and other electronic means as mutually agreed. You also agree that electronically executed coaching agreements, engagement letters, and other documents are valid and binding.

Website Acceptable Use

You agree to use this website for lawful purposes only. You will not:

  • Attempt to gain unauthorized access to any part of the website or its underlying systems
  • Use automated tools to scrape, harvest, or collect content
  • Submit false information through our forms
  • Use the website in any way that could damage or impair its functionality
  • Reproduce or redistribute website content except as expressly permitted

We reserve the right to remove content or restrict access if these Terms are violated.

Testimonials and Reviews

All testimonials and reviews on our website reflect the genuine opinion of the person identified, based on their actual experience with our services. Where a testimonial was provided in exchange for a benefit (free service, discount, gift), that material connection is disclosed at the point of publication.

We may edit testimonials for length or grammar without changing their meaning. We do not publish fabricated, AI-generated, or incentivized reviews without disclosure.

If you submit a testimonial or review, you confirm that it is genuine, based on your actual experience, and that you consent to its use on our website.

Limitation of Liability

To the maximum extent permitted by law, Peak Performance Consulting’s total liability for any claim arising from or relating to our services or your use of this website is limited to the amount you paid us for the specific service that gave rise to the claim.

We are not liable for indirect, consequential, incidental, special, or punitive damages — including lost profits, lost business opportunities, or damage to reputation — even if we were advised of the possibility.

Nothing in these Terms excludes liability for gross negligence, willful misconduct, or fraud, or excludes statutory rights that cannot be waived under Saskatchewan or Canadian law.

Indemnification

You agree to indemnify and hold harmless Peak Performance Consulting and Peter Neufeldt from any third-party claim arising from your misuse of our services, your breach of these Terms, or your violation of applicable law.

Termination

Either party may terminate an ongoing coaching engagement with 14 days’ written notice. Unused prepaid sessions are refunded on a pro-rata basis. Either party may terminate immediately for cause — including material breach, non-payment, or conduct that makes continuing the engagement unworkable.

After termination, the following sections survive and continue to apply: Intellectual Property, Confidentiality, Limitation of Liability, Indemnification, and Governing Law.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable in Saskatchewan.

If a dispute arises, we ask that you first contact us through the website contact form so we can try to resolve it directly. If we cannot resolve it through good-faith discussion, we agree to attempt mediation through the ADR Institute of Saskatchewan before proceeding to court. Either party may seek urgent injunctive relief in the courts of Saskatchewan at any time.

If the dispute is not resolved through mediation, it will be resolved in the courts of competent jurisdiction in Saskatchewan, Canada.

Force Majeure

Neither party is liable for failure or delay in performance caused by events beyond reasonable control, including natural disasters, pandemics, acts of government, or major infrastructure failures. If such an event prevents us from delivering a scheduled service, we will work with you to reschedule or provide a pro-rata refund.

Changes to These Terms

We may update these Terms as our services, licensing arrangements, or legal requirements change. The “Last Updated” date at the top of this page reflects the most recent revision. For material changes, we will also post a site notice. Continued use of the website or continued engagement with our services after a change constitutes acceptance of the updated Terms.

Severability, Waiver, and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision does not waive our right to enforce it later. These Terms, together with your specific engagement agreement (if any) and our Privacy Policy, constitute the entire agreement between you and Peak Performance Consulting regarding the subject matter.
